Terms of Service

These terms are an agreement between you and Milad Mirg LLC ("Mirg", "we", "us"). They cover the Mirg desktop app, the Mirg account service and this website (together, the "Service"). By creating an account or using the Service you agree to them.

1. What Mirg is

Mirg is a desktop app in which an AI agent helps you build games. The agent writes and changes files in a project folder on your computer, runs commands there, and runs your game to test it. It does this by sending your requests and relevant project content to AI model providers.

2. Your account

You sign in with an email address. You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher. If you are under 18, you need a parent or guardian's permission, and they must agree to these terms. Keep access to your email secure; you are responsible for what is done with your account. One person per account. The free plan is limited to a small number of accounts per computer.

3. Plans, usage and payment

Plans. Mirg has a free plan and paid plans, described on the pricing page. Each plan includes an amount of AI usage per billing period. Usage is measured by what the AI models cost to run for your requests, and the app shows how much of your plan you have used. Unused usage does not carry over.

Subscriptions. Paid plans are billed in advance each month through our payment provider, Stripe, and renew automatically until cancelled. You can cancel at any time in Settings → Manage billing; your plan then continues until the end of the period already paid for.

Extra usage on Max. If you are on the Max plan and turn on extra usage in Settings, you authorise us to charge your saved payment method automatically, in fixed amounts shown in the app, each time your included and previously purchased usage runs out, up to the limit per billing period that you choose. You can turn this off or change the limit at any time. Purchased extra usage that you have not used carries over.

Failed and disputed payments. If a charge is declined, or you dispute a charge with your bank or card provider instead of contacting us, we may suspend your account until the matter is resolved. Contact support@mirg.ai to restore it.

Refunds. Payments are non-refundable except where the law requires otherwise. If you were charged in error, contact support@mirg.ai within 14 days of the charge and we will correct it.

Changes to prices and plans. We may change prices or what a plan includes. We will give you notice before a change affects a subscription you are paying for, and you can cancel before it takes effect.

Taxes. Prices do not include taxes unless stated. You are responsible for any taxes that apply.

4. What you make is yours

Your projects are files on your own computer. As between you and Mirg, you own the games, code and other content you create with the Service, to the extent the law allows such content to be owned. We claim no rights in it. You are responsible for your projects, including making your own backups.

Content produced by AI models may be similar to content produced for other people, and may not qualify for copyright protection in some places. We do not promise that it is unique or free of third-party rights. If you publish or sell a game, you are responsible for checking that you have the rights you need.

5. Other companies' software and services

Mirg works with AI model providers and with game engines and tools made by others (for example Unity, Unreal Engine, Roblox Studio, Minecraft, Godot, Xcode and Android Studio). Your use of those is under their own terms and licences, which you are responsible for following, including any fees or royalties they charge. Mirg is not affiliated with or endorsed by them. Names and trademarks belong to their owners.

6. The agent acts on your computer

You direct the agent, and it edits files and runs commands in your project folder on your behalf. AI models make mistakes: code may contain errors, and a change may not do what you intended. Review what it does, use the Restore feature, and keep backups of anything you cannot afford to lose. Do not rely on the Service for anything where a mistake could cause injury, loss of important data, or serious financial harm.

8. The app and updates

We grant you a personal, non-transferable licence to install and use the app under these terms. The app updates itself from time to time. Features may change, and some are marked as limited or experimental.

9. Availability

We work to keep the Service running, but it depends on other providers and may be interrupted, slowed or limited, including by daily capacity limits. We do not guarantee that it will always be available or that any particular model will remain offered.

10. No warranty

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including that the Service or its output will be accurate, error-free, fit for a particular purpose, or non-infringing.

11. Limit of liability

To the fullest extent the law allows, Mirg will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US$50. Some places do not allow some of these limits, so they may not all apply to you.

12. Ending the agreement

You may stop using the Service and cancel at any time. We may suspend or end your access if you break these terms, if payment fails, or if we stop offering the Service. Sections that by their nature should continue (ownership, disclaimers, limits of liability) continue after the agreement ends.

13. Changes to these terms

We may update these terms. If a change is significant we will tell you in the app or by email before it takes effect. Continuing to use the Service after that means you accept the new terms.

14. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in the State of Delaware, unless the law where you live gives you the right to bring them elsewhere.
